A construction lien is meant for the benefit of construction professionals, such as contractors. There are many instances in which these workers perform their job duties, but are not paid for them. A lien of this particular magnitude will help protect the rights of the worker so they get the full and proper financial compensation for performing their services.
Construction liens can typically be filed by:
These liens can also be referred to as “mechanic’s liens” when real property is the issue. Real property lies in contrast to personal property because it encompasses improvements made to things such as buildings, roads, wells, and other things of that nature.
Without a construction lien, contractors would have very few options when it comes to enforcing payment. These liens will differ depending on the work was actually done and the cost of labor. If you are a construction worker or contractor and you have performed a service to real property that you were not appropriately compensated for, then our firm can help you. You are entitled to full payment for your services as a business person. If you do not receive it, we can help you get it.

Construction liens are explained under Title XL, Chapter 713 of the 2012 Florida Statutes. Under §713.03, should a professional perform any type of service, they have a liens under the law for any of the real property which they worked to improve. According to Florida law, real property is defined loosely as any piece of land which has been improved upon.
Essentially, this means that if you work on the property of another person and do not get paid for it, then the law affords you the right to enforce a claim against the property you worked on. Should you file a lien against a property, the property may be sold to pay for the labor, materials, and any other services that were performed during the improvement of it.
This can stand true if the contractor is paid but the suppliers and subcontractors did not receive proper or full payment. Due to this, it is extremely important that no time is wasted in getting the involvement of a knowledgeable attorney to help ensure your rights are fully protected.
