A contract is a legally binding agreement entered into by two or more parties. Each party that enters into the contractual agreement is legally obligated to fulfill some kind of duty. For example, when a contractor enters into an agreement with a business to do repairs, then the contractor will be obligated to perform construction to the business property and the business will be obligated to pay the contractor. They are both obligated in some way because of the contract.
Both parties entering into the contract will have a role to play. Typically, one party usually makes an offer while the other party accepts that offer. They must both come to a consensus as to the terms of the contract. Consideration must be given from one party to the other and usually takes on the form of monetary payment. Payment can only be enforced up to the amount that was stated in the contract. If you are facing disputes regarding a contract you entered into, then please come speak with our firm.
Just because you have come to an agreement with another party does not necessarily mean that you have entered into a legally binding contract. All too often, parties will make the mistake of thinking that no contract is necessary – especially when they trust the other party to make good on their word.
Unfortunately, things happen and without a contract, you could be stuck between a rock and a hard spot. A contract is necessary to pursue legal action should a dispute occur. Contracts can be the complete foundation for you and your business’ success, and for this reason, it will be crucial that you have an knowledgeable attorney work with you to make sure that it is legally binding and enforceable.
