What is a release of claims?
Generally speaking, a release of claims is an agreement made between an employee and their employer that delineates terms of employment and explains how they can be terminated. Both the employer and the employee are obligated to uphold this contract. Typically, the release form is signed in exchange for a severance agreement, and can be used by the employer to avoid lawsuits and other legal complications.
In many cases, an employee might be asked to waive filing a lawsuit under:
- Title VII of the Civil Rights Act,
- The Age Discrimination in Employment Act, or
- The Americans with Disabilities Act.
Always seek legal advice before accepting a severance agreement. Employers typically give their employees a certain amount of time to decide whether or not they want to sign the release. In this time, you can take the opportunity to find trusted legal counsel.
Do you need a wrongful termination lawyer?
Employers have the right to release you from employment at any time—except in the case of discrimination, retaliation, or other illegal procedures. If you believe that your employer has failed to offer you an appropriate severance agreement, or if you believe you can file a wrongful termination claim, don’t hesitate to contact an experienced legal advocate at our firm.
